Problem
Resolution/Complaint Investigation for Staff, Faculty, Student
Employees and Applicants
EEO/AA
staff are available to investigate discrimination complaints,
as well as, assist individuals who seek impartial advice or assistance
in resolving conflicts and complaints involving discrimination
or diversity issues. The staff maintain an impartial, balanced
and independent position in its approach. Assistance may include
policy research and clarification, counseling, referral to on
and off campus resources and facilitation of conflict resolution

Complaints
alleging discrimination may be filed with the EEO/AA office by
staff, faculty, student employees or applicants for employment.

Using
campus complaint procedures does not preclude an employee's or
applicant's right to file a complaint with the appropriate external
agency (e.g. Equal Employment Opportunity Commission, California
Department of Fair Employment and Housing) or preclude an employee
from filing a formal grievance under the appropriate labor agreement
or personnel policy. Civil remedies may also be available, including
injunctions and restraining or other orders. Note: Campus Labor
Relations grievance, and state and federal discrimination charge
processes and procedures all have filing time limits. The EEO/AA
Office suggests that employees and applicants consult the appropriate
agency or office regarding procedure deadlines.
Purpose/Policy
It
is the policy of the University not to engage in discrimination
against or harassment of any person employed or seeking employment
with the University of California on the basis of race, color,
national origin, religion, sex, gender identity, pregnancy, physical
or mental disability, medical condition (cancer-related or genetic
characteristics), ancestry, marital status, age, sexual orientation,
citizenship, or status as a covered veteran. This policy applies
to all employment practices, including recruitment, selection,
promotion, transfer, merit increase, salary, training and development,
demotion, and separation. This policy is intended to be consistent
with the provisions of applicable State and Federal laws and University
policies.
All
complaints of discrimination brought to the EEO/AA office are
taken seriously. The staff attempts to identify the problem and
reach a resolution as quickly as possible.
Confidentiality
EEO/AA
staff share consultation and complaint information only on a business
need to know basis. While we cannot promise absolute confidentiality
if a campus policy or a law are violated; we will only share information
as needed to conduct an investigation, to work toward a resolution
or as University or campus policy dictates.
Retaliation
Retaliation
against a person who files a complaint of discrimination, participates
in an investigation of such a complaint, or opposes an unlawful
employment practice is prohibited by Federal and State law and
University policy. Anyone who believes she or he has been retaliated
against for filing a complaint of discrimination is encouraged
to report the retaliatory actions to EEO/AA office.
